The Third Circuit today granted rehearing en banc in Brown v. Sage. In Brown, a panel majority (Judge Fuentes, joined by Chief Judge Smith) had ruled that a prisoner had not accrued three strikes under the Prisoner Litigation Reform Act, while Judge Chagares had dissented vigorously and urged the court to hear the case en banc.
