New opinion — Third Circuit issues opinion in transgender-bathroom case

Last month, a Third Circuit panel dramatically announced just minutes after the oral argument that it would affirm the district court’s ruling in favor a school district policy that allowed transgender students to use bathrooms corresponding with their gender identity. This afternoon, the Third Circuit issued its opinion, stating, “Although we amplify the District Court’s reasoning because of the interest in this issue, we affirm substantially for the reasons set forth in the District Court’s opinion.”

Joining McKee were Shwartz and Nygaard. Arguing counsel were Randall Wenger of the Independence Law Center for the appellants, Michael Levin of the Levin Law Group for the school district, and Ria Tabacco Mar of the ACLU for an intervenor.
